The preamble to the constitution reads “We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

It’s not a contract from the government granting us these rights under certain circumstances , it’s a contract from the people limiting the powers of congress to restrict our inherent freedoms as Americans. At least that’s how my smooth brain always interpreted it.

Yes, it is not a declaration of rights, but of restrictions against those rights. And amendment 9 says "just because we identified some rights here does not mean others don't exist".

At least a few of the Framers would agree that the Constitution is intended to be construed as: "For functioning government we acknowledge that some rights should be given up for the great good. But not these rights. You fuck with these rights and we need to burn it all down and start again."

I wasn't aware of that ruling, so I appreciate you mentioning it. In a sane world, that decision alone (not to mention Heller, which this decision heavily re-emphasizing) would be the death knell for the imbecilic argument that "the 2nd Amendment only applies to muskets!"

Unfortunately, since our nation has plenty of dimwitted gun-grabbers (and/or liars), we'll instead continue to hear that same absurd assertion for the rest of our lives. 😡

Too bad so many Republican politicians are criminals and hypocrites. Too much hinges on republican politicians and their use of 2A as a tool to get elected. The 2A is now more a political issue than a rights issue on both sides.

We have already recognized in Heller at least one way in which the Second Amendment's historically fixed meaning applies to new circumstances: Its reference to "arms" does not apply "only [to] those arms in existence in the 18th century." 554 U. "Just as the First Amendment protects modern forms of communications, and the Fourth Amendment applies to modern forms of search, the Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding." Ibid. (citations omitted). Thus, even though the Second Amendment's definition of "arms" is fixed according to its historical understanding, that general definition covers modern instruments that facilitate armed self-defense. Cf. Caetano v. Massachusetts, 577 U. S. 411, 411-412 (2016) (per curiam) (stun guns).
